How These Terms Work

  • Part A — General Website Terms apply to everyone who visits the Website, whether or not you go on to contact us.

  • Part B — Enquiries, Prints & Safaris explains, for information only, how print purchases and safari bookings actually happen (offline, by direct conversation) — the Website itself does not process any purchase or booking.

Definitions

  • "James Lewin Photography" is a trading name used by Lewin Management, a company registered in Kenya under company number [COMPANY NUMBER TO BE ADDED], with its registered office at Nanyuki, Kenya.

  • "Company" / "we" / "us" / "our" - Lewin Management, trading as James Lewin Photography.

  • "Website" — https://james-lewin.com

  • "Client" — a person who purchases a Product or books a Safari directly with us, outside the Website.

  • "Product" — a fine art photography print or related item.

  • "Safari" — any guided photographic safari, bespoke safari, or related travel experience arranged by us.

  • "Images" — all photographs, video, and other visual works displayed on the Website, including the Fine Art Collections, Safari pages, and Journal.

Part A — General Website Terms (Applies to All Visitors)

A.1 Acceptance

By accessing or browsing the Website, you agree to this Part A.

A.2 Ownership of Images

All Images are the copyright of James Lewin / Lewin Management and are protected under copyright law in Kenya and internationally. Nothing on the Website transfers any ownership or rights in an Image to you, however it is displayed, shared, or embedded.

A.3 Protecting Our Images — What You May Not Do

Viewing Images on the Website for your own personal enjoyment is permitted. You may not, without our prior written permission:

  • download, screenshot, screen-record, or otherwise copy any Image;

  • reproduce, republish, or redistribute any Image on another website, social media account, print, or product;

  • remove, crop out, or obscure any watermark, signature, or copyright notice;

  • use any Image, or any part of it, to train, fine-tune, or prompt any artificial intelligence or machine learning model, or as an input to a generative AI tool;

  • scrape, crawl, or use automated tools to harvest Images from the Website;

  • frame, hotlink, or embed any Image on another site; or

  • use reverse image search or similar tools to identify or contact any identifiable individual appearing in an Image.

We may use reasonable technical measures (such as watermarking, image sizing, or disabling right-click saving) to make copying harder, but these measures are not a guarantee, and using or copying an Image without permission remains a breach of these Terms and of copyright law whether or not a technical protection was in place or was circumvented.

Requesting permission.

If you would like to license an Image, feature it in press or educational material, or use it for any purpose beyond personal viewing, contact us at james@james-lewin.com — we're generally happy to discuss this.

Enforcement.

We actively monitor for unauthorised use of our Images and reserve the right to pursue copyright infringement claims, including takedown requests to hosting platforms, social media services, and search engines, against anyone who uses an Image without permission.

A.4 Other Website Content and Intellectual Property

Beyond Images, all other content on the Website — including text, logos, and design — is owned by or licensed to us and may not be copied or reused without prior written permission.

A.5 Acceptable Use

You agree not to misuse the Website, including attempting unauthorised access, introducing malicious code, or using the Website for any unlawful purpose.

A.6 No Warranty

The Website and its content (including the Journal) are provided "as is." We do not guarantee that all content is complete, current, or error-free, and nothing on the Website constitutes travel, medical, or legal advice, or a binding offer of sale (see Part B).

A.7 Cookies and Newsletter

Cookie use and newsletter sign-up data are described in our Privacy Policy. Signing up is optional and can be withdrawn at any time via the unsubscribe link in any email.

A.8 Links to Other Sites

The Website may link to third-party sites (e.g. Instagram, partner lodges). We are not responsible for the content or practices of any site we do not operate.

A.9 General Liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the Website. Nothing in this Part A limits liability that cannot be excluded under applicable law.

A.10 Governing Law

This Part A is governed by the laws of Kenya, with disputes subject to the exclusive jurisdiction of the courts of Kenya.

A.11 Changes

We may update these Terms at any time; the version published on the Website applies from that point.

Part B — Enquiries, Prints & Safaris (Information Only)

B.1 The Website Does Not Process Bookings or Sales

The Website is a showcase of James's photography and safari experiences, intended to generate enquiries. No Product purchase or Safari booking is made, paid for, or contractually agreed through the Website. Any resulting purchase or booking is arranged directly with us — by phone, email, or in person — and is governed by separate terms agreed with you at that time (for example, a booking confirmation, invoice, or written contract), not by these Terms.

B.2 Indicative Safari Process

For general information only, safaris are typically arranged as follows: an initial conversation, followed by a bespoke, no-obligation itinerary and quotation (availability is usually held for around two weeks); a deposit (typically around 30% of the total cost) to confirm the booking; and the remaining balance typically due around three months before travel. This is indicative only — it is not an offer capable of acceptance via the Website, and the actual price, deposit, balance due date, cancellation terms, and other conditions applicable to your trip will be set out in the booking confirmation issued directly to you.

B.3 Indicative Print Purchases

Prints from the Fine Art Collections are currently arranged directly with us rather than purchased through the Website. Pricing, production (made-to-order vs. stock), shipping, and copyright/usage terms for any print will be confirmed with you directly at the time of purchase.

B.4 Photography During a Safari

Where James personally photographs Clients during a Safari, delivered images are for the Client's personal use. Separate, explicit consent is always sought before any image of a Client is used in marketing, the Website, social media, or the Journal, and this consent may be withdrawn at any time (see our Privacy Policy).

B.5 Package Travel Notice

Because no booking is concluded via the Website, this notice is informational only. However, once a Safari is actually booked directly with us, it may constitute a "package" under the UK Package Travel and Linked Travel Arrangements Regulations 2018 (or equivalent legislation elsewhere), requiring prescribed pre-contract information and insolvency protection for advance payments at that stage. This should be checked with a travel law specialist, and the actual booking paperwork (not this Website) must satisfy these requirements before deposits are taken.

B.6 Governing Law for Any Booking or Purchase

Any Safari booking or Product purchase concluded directly with us is governed by the laws of Kenya, as will be confirmed in the relevant booking or sale documentation.
